1. Who we are

This Privacy Policy explains how American Building Development, the licensed California contractor (CSLB License #1060736) that operates the Decks & Balcony (California Decks & Balcony) brand, collects, uses and discloses personal information through www.decksandbalcony.com and when you contact Decks & Balcony by form, phone, e-mail or text message. In this policy, “we”, “us” and “our” mean American Building Development acting under the Decks & Balcony brand.

Your cookie choices and any sale/sharing opt-out on this website apply to this website only. Other websites operated by American Building Development have their own notices and their own choices.

2. Information we collect

Information you give us

Quote and inspection requests: your name, phone number, e-mail address, the property’s city or ZIP code, the type of property, your role (for example property manager, HOA board member or owner), the services you need, any project details you write, and whether you agree to receive text messages.
Calls, e-mails and texts: what you tell us when you contact us, and the details of the communication (phone number, time, content of e-mails and texts).
Project information: information about the property and work we provide estimates for or perform, and records of our communications about it.

Information collected automatically

Always (necessary): when you submit a form, our website stores the IP address, browser and device type and the page from which you submitted it, so we can deliver the request and detect spam and abuse. Our web host and its content delivery network process technical request data, such as IP address, to deliver and protect the site. A small cookie (dnb_consent) remembers your privacy choices.
Analytics — by default in the United States, elsewhere only if you allow it: Google Analytics measures how the site is used (pages viewed, device and browser type, approximate location derived from IP address, and whether a quote request was completed — not what you typed). If your browser is set to a United States time zone, it runs from your first page unless Global Privacy Control or your sale/sharing opt-out applies, and it then also includes ad measurement: when you call, e-mail or send a quote request after clicking one of our Google ads, Google Ads records that this conversion happened (with the ad click identifier, without your contact details and without remarketing or ad personalization); CallRail may show a tracking number so that a call can be linked to the ad or page that led to it; and the campaign parameters (utm_*) and Google ad click identifier are sent with your request; you can switch it off at any time (section 5).
Only if you allow Advertising (in the United States, apart from the ad measurement described above): Google Ads, the Meta Pixel and Meta Conversions API Gateway, CallRail call tracking and Observix collect identifiers stored in your browser, ad click identifiers, campaign parameters, pages viewed and interactions such as clicks on phone and e-mail links. Observix also records sessions on this site with form inputs masked and collects browser and device characteristics. When Advertising is allowed, the quote form also passes the campaign parameters and click identifiers that brought you to the site, and an Observix visitor identifier, along with your request.

We do not ask for sensitive personal information (such as Social Security, driver’s license or financial account numbers) through this website.

3. Sources of information

We collect personal information directly from you; automatically from your browser or device as described above; from the service providers listed in section 6 that help us run the website, track calls and measure advertising; and from people who refer you to us or act for you, such as a property manager, HOA representative or colleague.

4. How we use your information

to respond to your request, prepare estimates, schedule inspections and assessments, and perform and document our work;
to call or e-mail you about your request and our services, and to send text messages if you opted in to them;
to keep the website and our forms secure and to prevent spam, fraud and abuse;
to understand how the website is used and to improve it — by default for visitors in the United States, who can switch it off at any time, and otherwise only with your Analytics permission;
to measure which advertising and pages lead to calls and requests — by default for visitors in the United States as part of Analytics, otherwise only with your Advertising permission, and never while Global Privacy Control or your opt-out applies;
to support our advertising with audiences and partners such as Meta — only with your Advertising permission and never while Global Privacy Control or your opt-out applies;
to keep business, licensing, warranty, tax and legal records and to comply with the law and enforce our agreements.

5. Cookies and your choices

Advertising uses strict opt-in: nothing used for advertising loads, runs or stores identifiers in your browser before you allow it, and you can reject it as easily as you accept it. Analytics: if your browser is set to a United States time zone, Analytics runs by default — Google Analytics without Google signals and without ad personalization, plus the ad measurement described in section 2 (Google Ads conversion events, CallRail call tracking, campaign parameters and the Google ad click identifier sent with a request) — and you can switch it off with Reject non-essential or Cookie settings; it does not start on its own while Global Privacy Control or your sale/sharing opt-out applies. For visitors elsewhere, Analytics stays off until they allow it. You can change or withdraw your choice at any time with Cookie settings at the bottom of every page. A withdrawal stops future optional activity in this browser and removes the optional cookies we can access; it does not delete information that providers already received — see section 9 for how to ask for deletion. We disclose personal information only as described here:

Service providers that work for us: our web host (Hostinger); the workflow, automation and database tools that deliver your request to our team (an n8n workflow, Zapier and Airtable); e-mail and text-messaging providers that deliver our messages; and CallRail for call tracking. They may use the information only to provide their services to us.
Our team and contractors: staff of American Building Development, including its shared team mailbox, and subcontractors who need the information to prepare an estimate or perform work on your property.
Analytics and ad measurement: Google (Google Analytics; Google Ads conversion measurement) and CallRail — by default for visitors in the United States and otherwise with your permission, as described in section 5.
Advertising partners — only with your permission: Google (Ads remarketing and audiences, Tag Manager), Meta (Pixel and Conversions API Gateway), Stape (server-side tagging) and Observix. The Observix workspace is shared with other American Building Development websites, so activity recorded here with your permission can be combined with activity on those sites.
Legal and safety reasons: authorities, courts or others when the law requires it, or to protect rights, property and safety.
Business transfers: a buyer or successor if our business or its assets are sold, merged or reorganized.

When you allow Advertising, the advertising technologies described above give Google, Meta and our other advertising partners access to identifiers and browsing activity on this site. California law may treat that as a “sale” of personal information or “sharing” for cross-context behavioral advertising. These categories are involved: identifiers (cookie and click identifiers, IP address) and internet or other electronic network activity (pages viewed and interactions). In the United States, ad measurement also gives Google the ad click identifier and the fact that a call, e-mail or request followed an ad by default; we treat that the same way, so Global Privacy Control and the opt-out below turn it off.

You can opt out at any time, without creating an account, by selecting Do Not Sell or Share My Personal Information at the bottom of any page. The opt-out applies to this browser. We also treat a Global Privacy Control (GPC) signal from your browser as a valid opt-out for that browser: while it is on, advertising stays off and cannot be switched on here, and once we have received it we keep the opt-out on record for this browser. Choosing “Accept all”, a later update of this policy or a change of our technologies does not cancel an opt-out. Analytics remains a separate choice that you can allow or refuse.

Our website does not respond to “Do Not Track” browser signals, because there is no common standard for them; it does honor GPC as described above.

8. Your privacy rights

Depending on where you live and the laws that apply, you may have the right to:

know what personal information we collect, use and disclose, and get a copy of it;
ask us to correct inaccurate personal information;
ask us to delete personal information, subject to exceptions allowed by law (for example records we must keep);
opt out of the sale or sharing of personal information (see section 7);
not be discriminated against for exercising these rights.

9. How to make a request

To protect your information, we will ask you to confirm details we already have — for example the e-mail address or phone number you used — before we act on a request to know, correct or delete. An authorized agent may make a request for you with your signed permission; we may ask you to confirm your identity directly. We will respond within the time required by applicable law and tell you if we need more time or cannot fulfill a request, and why. The browser opt-out of sale/sharing in section 7 does not require any verification.

10. Text messages

We send text messages only if you check the optional text-message box on our forms. Texts relate to your request (for example confirmations, scheduling and updates). Message frequency varies and message and data rates may apply. Reply STOP to stop or HELP for help. Agreeing to texts is never a condition of requesting a quote or using our services. Your mobile number and text-message consent are used to send you our messages through our messaging service provider.

11. How long we keep information

Requests and customer records: for as long as we need them to respond to you, provide estimates and services, and maintain our business relationship, and afterwards for as long as needed to meet legal, licensing, warranty, tax and accounting obligations and to resolve disputes. Then we delete or de-identify them.
Spam and security data stored with form submissions (IP address, browser, page): for as long as the submission itself is kept.
Your privacy choices: the dnb_consent cookie lasts 12 months; a new choice replaces it.
Analytics and advertising cookies: for the periods listed in the Cookie Notice, and only while the category is on — Advertising after you allow it, Analytics by default in the United States or after you allow it. Data that providers received is kept according to their own retention settings and policies.

12. Security

We use administrative, technical and physical safeguards appropriate to the information we handle, such as encrypted (HTTPS) connections to this website. No method of transmission or storage is completely secure.

13. Children

This website is intended for property owners, property managers and businesses. It is not directed to children under 16, and we do not knowingly collect personal information from them or sell or share it.

14. Changes to this policy

When we update this policy we change the “Last updated” date at the top. If we add optional technologies or new purposes, we will ask for your choice again before using them; an existing opt-out stays in place.
